What is mediation?
Mediation is a flexible, confidential, and cost-effective solution for resolving disputes, empowering parties to craft tailored agreements that address their unique needs. Quicker, cheaper, and less stressful than legal battles, mediation often leaves parties with a sense of relief and a solid agreement in hand.
Mediation is only suitable if all parties agree to negotiate in good faith to resolve the dispute.
What happens in a mediation?
Before mediation, the mediator meets each party privately to assess the issues in dispute and see if mediation is the right fit. Parties may be asked to share information or a position statement ahead of the mediation.
At the mediation session, the mediator brings the parties together to identify interests and issues, develop options, consider alternatives and negotiate to reach agreement.
The mediation will usually include:
a joint session of the participants in which the participants communicate directly with each other; and
separate private sessions where each party meets privately with the mediator.
Any agreement reached by the parties at the mediation is documented before the mediation concludes.
As the mediation is confidential, any third parties attending the mediation will be required to sign a confidentiality agreement prior to the mediation.
How to arrange a mediation?
Once parties agree to proceed with mediation to settle their dispute, they must agree on a mediator. The mediator is an independent, neutral person who has no interest in the outcome of the dispute.
The mediator will ask parties to sign an Agreement to Mediate. This document formalises the process and outlines the terms and confidentiality obligations for everyone involved.
The mediator will coordinate with all parties (and their legal representatives) to confirm the date, time, and location for the mediation session.
